承包商违约

尽管有上述规定，此等不符合应视为承包商违约。

Notwithstanding the above , such non-conformity shall be deemed a default of the contractor .

如果因承包商违约而暂停履行合同，业主不应向承包商支付款项。

No payment shall be made to the contractor in the event that the company suspends the performance of the contract for reasons of default of the contractor .

如果业主因承包商违约而发出暂停通知，暂停通知应包括通知发布原因，并列出承包商在规定期限内纠正该情况所需采取的步骤。

In the event the company issues a suspension notice for reason of default of the contractor , the suspension notice shall include reasons for such issuance and shall also outline the steps to be taken by the contractor to rectify the situation within a specified period .

承包商任何违约及过失均视为违反本合同，雇主有权依照《合同条件》的规定终止与承包商终止雇佣关系。

Any breach or default by the contractor Shali be construed as a fundamental breach of this contract which would entitle the employer to terminate the employment of the Contractor pursuant to the conditions of contract .

若该情况不能得以纠正并达到业主满意度，承包商应视为违约，业主可在不影响其它权利的情况下，执行合同终止权。

The Contractor shall be considered in default of its obligations until the situation has been remedied to the satisfaction of the company and the company may , in addition to and without any prejudice to any other rights it may have , exercise its right of termination .
